Terms of Use

1. Who we are
SoloBay is operated by Solo Bay Ltd, a company registered in England and Wales under company number 17415499, with its registered office at Unit A, 82 James Carter Road, Mildenhall, IP28 7DE.
In these terms, "we", "us" and "our" mean Solo Bay Ltd. "You" means you, the person using the SoloBay app or website. "SoloBay" means our mobile application and the website at solobay.co.uk.

2. These terms
By downloading, accessing or using SoloBay you agree to these terms. If you do not agree to them, please do not use SoloBay.
We may change these terms. If we make a change that materially affects your rights we will tell you in the app or by email before it takes effect, and you will have the chance to stop using SoloBay if you do not accept it. The date at the top shows when these terms were last changed.
Our Privacy Policy explains what we do with your personal data and forms part of your agreement with us.
3. What SoloBay does
SoloBay helps motorcyclists find motorcycle parking. It shows the locations of motorcycle bays, information about them such as capacity and restrictions where we hold it, and directions to them.
SoloBay may also link you to a third party app or website in order to pay for your parking. Where it does, that payment is a matter between you and that third party, on their terms, and we are not part of it.
4. Bay information, and what we do not promise
Our bay data comes from local authority records, our own surveys, publicly available information and reports from riders. We work hard to keep it accurate and we correct errors when we find them.
But we cannot guarantee that it is accurate, complete or current, and you must not rely on it as the final word. Bays are removed, suspended, resurfaced and re-signed, restrictions change, charges are introduced, and authorities do not always tell anyone. Enforcement is carried out by the authority against the signs and markings on the street, not against our app.
We are not responsible for penalty charge notices, fines, clamping, removal or any other loss you suffer because bay information in SoloBay turned out to be wrong or out of date, except where the law does not allow us to exclude that responsibility. See section 9.
5. Reports from riders
You can report bays, corrections and problems. If you do:
- Tell us the truth as best you know it. Do not deliberately submit false information.
- Do not submit anything unlawful, offensive, or that infringes someone else's rights.
- You keep ownership of what you submit, but you give us a worldwide, royalty free licence to use, store, adapt and publish it within SoloBay and our data set. We may share aggregated or anonymised bay data with local authorities and parking industry bodies.
- We may edit or remove submissions, and we do not promise to act on any of them.
Never use SoloBay while riding. Set your destination before you set off, or stop somewhere safe.
6. Your account
Some features need an account. If you create one:
- Give us accurate information and keep it up to date.
- Keep your login details to yourself. You are responsible for what happens on your account.
- Tell us promptly at hello@solobay.co.uk if you think someone else has access to it.
- You must be at least 18, or old enough to hold a licence for the vehicle you are parking.
You can delete your account at any time from within the app. Deleting it removes your personal data in line with our Privacy Policy.
We may suspend or close your account if you break these terms, if we are required to by law, or if we reasonably believe your use of SoloBay is fraudulent or is harming other users. Where we reasonably can, we will tell you why and give you a chance to put it right.
7. SoloBay Pro
7.1 What it is
SoloBay Pro is an optional paid subscription. It removes advertising and unlocks the Pro features listed on our pricing page and in the app. What is included, and the current price, are always shown before you buy.
Current prices: £4.99 per month or £19.99 per year. Prices include VAT where it applies.
7.2 Where you bought it decides who takes the money
This matters, because it decides who you deal with about billing, cancellation and refunds.
If you subscribed on solobay.co.uk, Solo Bay Ltd sells the subscription to you directly. We take the payment, our card processor is Stripe, and the charge appears on your statement as SOLOBAY.CO.UK. Everything in sections 7.3 to 7.7 applies to you, and you deal with us.
If you subscribed inside the iOS app, Apple sells the subscription to you through your App Store account. Apple takes the payment, Apple manages the renewal, and Apple handles cancellation and refunds under Apple's own policies. We cannot cancel an App Store subscription for you, and we cannot refund one. Section 7.4 tells you how Apple's renewal works, and you cancel and claim through Apple.
Buying Pro in one place does not create a second subscription in the other. If you think you are paying twice, email us at hello@solobay.co.uk and we will sort it out.
7.3 Your first three days
When you create a SoloBay account we give you three days of Pro, free. We do not ask for a payment method and we do not charge you anything.
When those three days end, your account moves to the free version. Nothing is charged, nothing renews, and there is nothing to cancel. If you want to keep Pro, you subscribe when you are ready, and that is a separate step you choose to take.
Three free days are given once per account.
7.4 Automatic renewal
The rest of this section describes subscriptions bought on solobay.co.uk. If you subscribed in the iOS app, Apple manages your renewal. Your subscription renews automatically unless you turn off auto renewal at least 24 hours before the end of the current period, Apple charges your App Store account within 24 hours before the period ends, and Apple handles any failed payment. You can turn off auto renewal at any time in your App Store account settings.
Your subscription renews automatically at the end of each period, for the same period, at the price then shown, until you cancel. A monthly subscription renews every month. An annual subscription renews every year.
We take payment on or shortly before the renewal date, using the payment method on your account. For annual subscriptions we email you a reminder before the renewal, to the address on your account.
If a payment fails we will retry it and tell you. If it keeps failing we will end the subscription and your account reverts to the free version. You do not lose your account, your saved places or your data.
7.5 Cancelling
Web subscriptions. Cancel at any time on solobay.co.uk from Settings, then Manage subscription, or by emailing hello@solobay.co.uk from the address on your account. It takes one click and we do not put anything in the way of it.
Cancelling stops the next renewal. It does not end the period you have already paid for: you keep Pro until the end of that period, then the account moves to the free version.
App Store subscriptions. Cancel through your App Store account settings. Deleting the app does not cancel it.
Deleting your SoloBay account does not by itself cancel an App Store subscription. Cancel that through Apple first.
7.6 Refunds
This section covers subscriptions bought on solobay.co.uk. Refunds for App Store purchases are handled by Apple.
Your first payment: 14 days, no questions. If you are within 14 days of your first paid charge and you are not happy with Pro, email hello@solobay.co.uk and we will refund that payment in full. You do not have to give a reason. This applies whether or not you have used the Pro features, and it is a better deal than the law requires us to give you, so we are not going to argue about it.
Annual renewals. If we charge you for a renewal year and you ask within 14 days of that charge, we refund the unused part of the year, pro rata to the nearest whole month.
Monthly renewals. We do not refund a month that has already started, because cancelling takes one click and you keep access to the end of it. If you were charged for a month you clearly did not intend to buy, tell us and we will look at it properly rather than pointing at this paragraph.
Charged but no access. If we have taken your money and Pro has not been enabled on your account, that is our failure. We fix it or refund it in full, whichever you prefer.
Duplicate charges are refunded in full, always.
Refunds go back to the card you paid with. Refunds usually clear within 5 to 10 working days, depending on your bank.
We do not hold money for you. There is no SoloBay wallet, no stored balance, and no credit you can spend. Reward days of Pro earned in the app are free access to the service, not money. They have no cash value, they cannot be exchanged for cash, and they cannot be transferred to anyone else.
Your legal cancellation right. Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 you have a right to cancel a distance contract within 14 days. By subscribing and getting immediate access to Pro, you ask us to start supplying the service straight away, which can reduce that right. The 14 day refund we offer above is given regardless, and nothing in these terms affects your statutory rights as a consumer.
7.7 Price changes
This section applies to subscriptions bought on solobay.co.uk. For an App Store subscription, Apple tells you about a price change and asks for your agreement where Apple's rules require it.
We may change the price of Pro. If we do, we will tell you at least 30 days before it affects you, by email to the address on your account.
The new price applies from your next renewal. If you do not want to pay it, cancel before that renewal and you will not be charged. We will never change the price of a period you have already paid for.
We sometimes offer discount codes. Where one applies, the discounted price and how long it lasts are shown before you pay.
7.8 Changes to what Pro includes
We may add to Pro, and we may change or withdraw individual features. If we materially reduce what Pro includes during a period you have already paid for, email us and we will put it right. For a subscription bought on solobay.co.uk that may include a refund of the affected part of that period. For an App Store subscription, any refund is Apple's to give, so we will put it right in the app instead.
8. Free features
Features that are free today may change or be withdrawn. We will not withdraw something you have paid for during the period you have paid for it.
9. Our responsibility to you
Nothing in these terms limits or excludes our liability for:
- death or personal injury caused by our negligence
- fraud or fraudulent misrepresentation
- anything else that the law does not allow us to limit or exclude
Subject to that:
- We provide SoloBay with reasonable care and skill, as required by the Consumer Rights Act 2015. If we fail to do so, you have rights under that Act which these terms do not affect.
- We are not liable for losses that were not foreseeable at the time you started using SoloBay. A loss is foreseeable if it is obvious that it will happen, or if we both knew it might happen when you began using the service.
- We are not liable for penalty charge notices, fines, clamping or vehicle removal.
- We are not liable for loss or damage to your motorcycle, or to anything left with it.
- We are not liable for the acts or omissions of local authorities, parking operators, or third party payment apps we link you to.
- Where we are liable, our total liability to you for all claims arising in any 12 month period is limited to the greater of £100 and the total amount you paid us through SoloBay in that period.
SoloBay is provided for personal, non commercial use. If you use it for business purposes we are not liable to you for loss of profit, loss of business, business interruption or loss of business opportunity.
10. Things you must not do
Do not:
- use SoloBay unlawfully, or to help anyone else break the law
- try to gain unauthorised access to SoloBay, our servers or our data
- scrape, copy, extract or reuse our bay data other than through the app as intended
- reverse engineer, decompile or attempt to derive the source code of the app, except to the extent the law expressly permits
- introduce malware, or interfere with the operation of SoloBay for anyone else
- impersonate anyone, or submit information you know to be false
- resell, sublicense or commercially exploit SoloBay or its content without our written permission
11. Our intellectual property
SoloBay, including the app, the website, our bay data set, our branding and the SoloBay name, belongs to us or is licensed to us. We grant you a personal, non exclusive, non transferable, revocable licence to use the app on devices you own or control, for your own use, in accordance with these terms. That licence ends if these terms end.
Our bay data set is our property. Individual bay locations are facts, but the compiled data set is protected as a database. You may use it through the app. You may not extract or reuse substantial parts of it.
12. Availability
We aim to keep SoloBay available but we do not promise it will be uninterrupted or error free. We may suspend it for maintenance, and we will give notice where we reasonably can. We may change or withdraw features. SoloBay depends on your device, your network connection and third party services including mapping and location, and we are not responsible for failures in those.
13. Apple
This section applies only if you obtained the SoloBay app from the App Store.
These terms are between you and us, not with Apple. Apple is not responsible for SoloBay or for supporting it. If the app fails to conform to any applicable warranty you may notify Apple and Apple will refund the purchase price where one was paid, and to the maximum extent permitted by law Apple has no other warranty obligation. Apple is a third party beneficiary of these terms and may enforce them against you.
We, not Apple, are responsible for any claim that SoloBay fails to meet a legal or regulatory requirement, and for any claim brought under product liability or consumer protection law.
We, not Apple, are responsible for investigating and resolving any claim that SoloBay infringes someone else's intellectual property rights.
You confirm that you are not located in a country subject to a UK, EU or United States government embargo, and that you are not on any government list of prohibited or restricted parties.
14. Ending this agreement
You may stop using SoloBay at any time by deleting your account and removing the app. Remember to cancel any Pro subscription, through your account on solobay.co.uk or through Apple, depending on where you bought it.
We may end this agreement, and your access to SoloBay, if you materially break these terms and do not put it right within a reasonable time of us asking you to, or immediately where the breach cannot be put right or where we are required to act by law.
Sections that by their nature should survive, including intellectual property, liability and governing law, continue after this agreement ends.
15. Complaints
If something has gone wrong, email hello@solobay.co.uk. Tell us what happened and what you would like us to do. We aim to acknowledge within 2 working days and to resolve within 14.
16. Other terms
- If any part of these terms is found to be unlawful or unenforceable, the rest continues to apply.
- If we do not insist that you do something, or delay in enforcing our rights, that does not mean we have given up those rights.
- We may transfer our rights and obligations under these terms to another business, and we will tell you if we do. You may not transfer yours without our written consent.
- Only you and we have rights under these terms, except that Apple has the rights described in section 13.
17. Governing law
These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in your own courts, and you keep the benefit of any mandatory consumer protections that apply where you live. Otherwise the courts of England and Wales have exclusive jurisdiction.
Nothing in these terms affects your statutory rights as a consumer.
